1. What IndexAppeal Is
IndexAppeal ("we," "our," "the Service") provides property tax analysis reports for residential properties in Harris, Dallas, and Collin County, Texas. We analyze publicly available appraisal data to estimate whether a property may be over-assessed relative to comparable properties, and generate evidence reports that homeowners can use when filing a property tax protest.
2. What IndexAppeal Is Not
We are not a law firm, tax advisor, CPA firm, or licensed property tax consultant. Our reports do not constitute legal advice, tax advice, or a professional appraisal. We do not file protests on your behalf, represent you at hearings, or guarantee any specific outcome. The decision to protest and how to present your case is entirely yours.
3. Our Data
All property data used in our analysis comes from official public records published by Harris Central Appraisal District (HCAD), Dallas Central Appraisal District (DCAD), and Collin Central Appraisal District (CCAD). This data is published by the counties as public domain information.
While we make reasonable efforts to keep data current, property records change. Values may have been updated since our last data refresh. Physical condition, renovations, and features not captured in public records may affect your property's actual market value. Always verify your property details against your Notice of Appraised Value.
4. Estimates and Savings
All savings figures, value estimates, and reduction percentages shown on our website and in our reports are estimates based on statistical comparison to similar properties. They are not guarantees of what you will save. Actual outcomes depend on many factors including the Appraisal Review Board's independent judgment, the quality of your presentation, property condition, and market conditions. Your assessed value could remain the same after a protest. It will not increase as a result of protesting.
5. Comparable Property Selection
We select comparable properties using criteria aligned with Texas Property Tax Code Section 41.43, including similarity in size, age, location, and construction type. Our algorithm uses a tiered approach, prioritizing close matches and expanding criteria when necessary. Comparable properties may differ from your property in ways not visible in public data, including interior condition, upgrades, and lot characteristics.
6. Purchases and Pricing
Report pricing varies based on the estimated savings for each property. Prices are displayed before purchase. All sales are final. Because our reports are generated from data that is immediately delivered, we do not offer refunds.
If you believe there is a material error in your report (incorrect property, wrong account number, or data that does not match your county's records), contact us and we will investigate and, if warranted, regenerate your report at no charge.
7. Your Account
You are responsible for maintaining the security of your account credentials. Each account is for individual use. You may not share account access or purchased reports for commercial resale. You may share your own report with your spouse, tax advisor, or legal counsel for the purpose of protesting your own property taxes.
8. Deadlines Are Your Responsibility
We display protest deadlines based on published county guidelines. However, your actual deadline is the date printed on your Notice of Appraised Value. We are not responsible if you miss a deadline based on information displayed on our site. Always verify your deadline directly with your county appraisal district.
9. Limitation of Liability
To the maximum extent permitted by law, IndexAppeal's total liability to you for any claim arising from your use of the Service is limited to the amount you paid for your report. We are not liable for indirect, incidental, or consequential damages, including but not limited to lost tax savings, missed deadlines, or decisions made based on our estimates.
10. Intellectual Property
The underlying property data is public domain. Our analysis methodology, report design, website content, and software are proprietary. You may use your purchased report for personal property tax protest purposes. You may not reproduce, redistribute, or resell our reports, analysis methodology, or website content.
11. No Affiliation
IndexAppeal is not affiliated with, endorsed by, or connected to any county appraisal district, Appraisal Review Board, the Texas Comptroller of Public Accounts, or any government agency.
12. Changes to These Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via the email associated with your account.
13. Governing Law
These terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Dallas County, Texas.
